General Conditions of Sale


These conditions (hereinafter the “General Conditions of Sale”) regulate all sales contracts concluded between the user (hereinafter the “Customer”) and the company Selleria Pigna, a brand of Tecno Arredo 3 Srl, via the website www.selleriapigna.com (hereinafter the “Site”) and having as their object the products present in the virtual windows of the Site.
The Customer acknowledges and accepts that all communications relating to the General Conditions of Sale and other communications that the Customer and Selleria Pigna will exchange in electronic form satisfy the requirement of written form, except for the specific indications in these General Conditions or the different provision of Law. In order to conclude purchases on the Site, the Customer must register and create his/her account on the Site as indicated in the following point 1).
The sales that can be carried out on the Site are therefore subject to these General Conditions of Sale.
Selleria Pigna reserves the right to modify the General Conditions of Sale at any time, without prejudice to the application to the individual sale of the General Conditions of Sale in force at the time the purchase order is sent by the Customer.
It is therefore understood that any changes and/or new general conditions of sale will come into force from the moment of their publication on the Site. For this reason, Customers are invited to regularly access the Site and to verify the possible publication of updated general conditions of sale.


1. ACCESS TO THE SITE AND REGISTRATION

Access to the services offered by the Site is permitted to any user.
Registration is completely free.
To create your account, the Customer must click on “Register”, fill out the appropriate form with all the required information and send it via the “Send” button. The Customer will receive a confirmation email from Selleria Pigna.
At the time of registration, the Customer must also express, by checking the appropriate box, his acceptance of the General Conditions of Sale. It is therefore understood that failure to accept the General Conditions of Sale will make it impossible to complete the registration procedure and, therefore, to make purchases on the Site.
By registering, the Customer guarantees that the information provided is true and complete.
The “login” credentials to the Site are strictly personal and cannot be transferred or used in any way by third parties.
By registering on the Site and approving these General Conditions of Sale, the Customer agrees to receive commercial notices relating to the products from time to time present on the virtual windows of www.selleriapigna.com at the email address indicated at the time of registration. This authorization may be revoked at any time if the Customer decides not to wish to receive the aforementioned notices by following the instructions at the bottom of the email or by writing to info@selleriapigna.com.

2. INFORMATION DIRECTED TO THE CONCLUSION OF THE CONTRACT (Art. 12 Legislative Decree 70/2003).

Pursuant to Legislative Decree 70/2003, containing regulatory provisions for electronic commerce, the Customer declares to be informed of the following information:
a) the display of the Products on the Site constitutes an invitation to offer addressed to Selleria Pigna; this means that by ticking one or more products, they will simply be placed in your cart pending the execution of the subsequent phases of conclusion of the sales contract;
b) once the selection of the products to be purchased has been completed, the Customer must click the “proceed to complete the order” button and enter his/her billing details;
c) by clicking on “proceed to complete the order” the Customer will be able to view a summary of the choices made and possibly correct them in the event of input errors and/or omissions;
d) after having confirmed the choices and indicated the payment method among those available, the Customer will constitute the purchase or reservation or booking of the products present in the cart in accordance with the General Conditions of Sale;
e) upon receipt of the order, Selleria Pigna will send an order confirmation to the email address indicated by the Customer, which will contain the total amount due by the Customer. This confirmation email only constitutes the reservation of the product and will activate the order verification process and subsequent processing and shipping of the products. The order is considered confirmed and accepted by Selleria Pigna only upon sending the email confirming the processing of the ordered product.
f) All email correspondence with the customer will be archived in the Selleria Pigna database for the time necessary to process the order and, in any case, within the terms of the law.
g) Despite our best efforts, we cannot exclude that for a small part of the products on our e-commerce site, a price different from the actual one is indicated by mistake. In any case, we will check the correctness of the product prices during the order verification process and subsequent processing and shipping of the products. If, due to misunderstandings or other inconveniences, the price indicated on the site is lower than the correct selling price of a product, we will contact you to verify whether you still wish to purchase the product at the correct price. Otherwise, your order cannot be accepted. If the correct price of a product is lower than that indicated on the site, we will only charge you the lower correct price and will still ship you the product.
h) despite Selleria Pigna's utmost commitment, the Customer acknowledges and accepts that in some cases it is possible that one or more of the chosen products may not be available (please refer to point 2 of these General Conditions of Sale);
i) in the "my orders" section the Customer will be able to access his/her orders at any time and consult their fulfillment status.
l) the Customer will be notified of the delivery of the products within 72 hours, via a communication to the email address indicated during the purchase phase;
m) once the official notification of shipment has been sent ("your order has been shipped"), the customer will no longer have the right to cancel the order.


3. PRODUCT AVAILABILITY AND PRICES

The products published on the showcase will remain available for an indefinite period of time and for an unlimited number of products.
All product prices, shipping costs and any additional costs will be expressed separately in Euros and are inclusive of VAT (Value Added Tax).
The price of the products may be changed without notice, it being understood that the price charged to the Customer will be the one published on the Site and reported on the order confirmation sent by International design. The products will remain the property of Selleria Pigna until the Customer has paid in full the purchase price, shipping costs and any other additional costs.
It may happen, also due to the possibility that more Customers purchase the same product at the same time, that the product is no longer available. If the payment of the amount due for the product (including shipping costs and any additional costs) has already been made, Selleria Pigna will send the Customer a communication via email communicating the amount of the refund (price and shipping costs and any other additional costs paid).
In the case of an order containing multiple products, the unavailability of one or more of the products will not give the Customer the right to cancel the entire order. Partial cancellations will therefore correspond to partial refunds.


4. PAYMENT METHODS

The payment method is the one chosen by the Customer among the options:
• credit card
• prepaid card
• bank transfer
• PayPal
• Clear
If you buy with Klarna you will receive your order immediately and pay in 3 installments. You acknowledge that the installments will be assigned to Incremento SPV Srl, related entities and their assignees, and that you authorize such assignment.
Security is a priority for Tecno Arredo 3, therefore your information will be encrypted. All payments will be processed through a secure server-to-server connection using the SSL (Secure Sockets Layer) protocol with 128-bit encryption and VERISIGN protocol.

5. SHIPPING AND DELIVERY OF PRODUCTS – ACCEPTANCE WITH RESERVATION

The delivery time is indicated on each product sheet and is understood from payment received, in particular cases a communication will be sent that will prevail over any other indication as it takes into account all the particularities of the case (e.g. presence of multiple products, distance, inconvenient locations, foreign delivery etc.). Selleria Pigna is not responsible for delays caused by couriers.
In the event of unforeseen events that cause delays or inconveniences for the Customer, such as, for example, unforeseeable circumstances or force majeure, Selleria Pigna will send the Customer an email containing, in some cases, a free coupon to spend on www.selleriapigna.com.
Pursuant to art. 63 of the Consumer Code, the Customer, upon delivery, must check the conformity of the number of packages and their condition. Any damage to the packaging/wrapping of the products must be promptly contested by placing a written control reservation on the proof of delivery. Once the delivery document has been signed without reservations, the Customer is precluded from any possibility of contesting the external characteristics of what has been delivered.
In case of “Acceptance with reservation” of the package received, the Customer is required to immediately send an email to info@selleriapigna.com to which the Customer must attach some photographs of the package.
To be valid and enforceable, acceptance with reservation must be complete and indicate, at the time of delivery, the specific reason why the reservation is made (e.g. I accept with reservation because the package is open, or, I accept with reservation because the package is wet, etc.), otherwise the refund cannot be made.
In the event that the packaging does not show any apparent damage and the Customer signs without reservation, if the goods are damaged, the Customer can resort to "hidden damage", i.e. those damages that are not verifiable by looking at the package externally. Hidden damage according to Article 1698 of the Civil Code is the responsibility of the shipper and in this case the dispute must be sent by registered mail with return receipt to the shipper within and no later than 8 days from receipt of the shipment, attaching photos of the damage.
In the event that the carrier has been chosen by the Customer, the risk of damage or deterioration of the products is transferred to the Customer already at the moment of delivery of the goods to the carrier, precluding any dispute regarding the external characteristics of what has been delivered. In this case, any dispute must be raised by the Customer against the carrier.
The products will be delivered to the street level. Delivery to the floors is not foreseen unless agreed with a quotation. In the event that, on the order confirmation page at point 5, delivery to the floor is not expressly indicated, the service is not foreseen in any case.


6. PRODUCT WARRANTY

All products purchasable on the Site are covered by the legal guarantee.
In particular, the rights arising from this guarantee may be exercised provided that the products have been used according to the instructions specific to each of them and in any case correctly with due diligence, in full compliance with the intended use and with what is set out in the enclosed instructions, as well as upon presentation by the Customer of the accompanying invoice.
Where the Customer is a consumer, Selleria Pigna provides the guarantee of conformity pursuant to art. 128 et seq. of the Consumer Code (Legal Guarantee). In this case, therefore, the Customer will have the right:
- to restore the conformity of the goods without costs through repair or replacement, pursuant to paragraphs 3, 4, 5 and 6 of art. 130 of the Consumer Code, or
- to an appropriate reduction in the price or to the termination of the contract, in accordance with paragraphs 7, 8 and 9 of the same article of law.
Selleria Pigna is liable for defects of conformity if these occur within two years from the date of delivery of the product.
In order to benefit from the Legal Guarantee, the Customer must report the lack of conformity to Selleria Pigna within two months of its discovery. The action aimed at asserting the lack of conformity expires in any case within twenty-six months of delivery.
It is understood that due to the settings of the computer systems, computers and screens used by the Customer, the images and colours of the products published on the Site may be different from the actual ones.
The costs related to the return of products as a result of the exercise of the guarantee will be borne by Selleria Pigna and/or the supplier partners.


7. REFUNDS

In the event of unavailability of the product or withdrawal by the Customer, as better regulated in these General Conditions of Sale, Selleria Pigna will instruct its Credit Institute to refund the amount paid at the time of purchase.
The refund may in any case take place within thirty days from the date of actual receipt of the payment by the Customer, by crediting the means and to the coordinates indicated by the latter.


8. RIGHT OF WITHDRAWAL AND RETURN PROCEDURE

In accordance with the provisions of articles 52 et seq. of Legislative Decree 205/2006 (consumer code), the Supplier recognizes the Consumer Customer's right to withdraw from the contract, without having to provide any reason, by returning the purchased products with consequent refund of the price or replacement with another product.
To exercise the right of withdrawal, the Customer must inform us (Tecno Arredo 3 Srl, Via Cantalupo 4 - 47042 Cesenatico (FC) +39 3467866457 - Tel 0547671196 email info@selleriapigna.com) of his decision to withdraw from this contract by means of an explicit declaration (for example a letter sent by post or email). To comply with the withdrawal deadline, it is sufficient for the Customer to send the communication relating to the right of withdrawal before the withdrawal period expires.
The Customer has the right to withdraw without any penalty within 14 working days of receiving the goods:
a. in the case of purchase of goods, from the day on which the Customer acquires physical possession of the goods
b. in the case of a contract relating to multiple goods ordered in a single order and delivered separately, from the day on which the Customer acquires physical possession of the last good

Upon receipt by Selleria Pigna of the Customer's notice of withdrawal, in the manner and within the terms set out above, the contract will be deemed terminated and Selleria Pigna will refund the amount paid by the Customer.
In any case, the right of withdrawal is subject to the following conditions:

The right of withdrawal is subject to the following conditions:
  • Returns from Switzerland and other non-EU countries (EC) are not accepted.
  • Returns and exchanges of saddles of any type are not accepted.
  • Returns of KEP Italia, Kask helmets and customized items are not accepted
  • Returns of airbags are not accepted
  • No returns of boots accepted
  • Returns and exchanges of items in the outlet section, on sale and/or with a discount of more than 30% are not accepted.
  • Returned items must not have been worn, washed, ironed or treated in any way. Items must be intact, in their original condition and properly wrapped and packaged. The shipment must be made using the same original packaging in which the product was received.
  • All labels on the garment, whether fabric or hanging, must be intact and must not have been removed from the item.

There are two ways to return/exchange a product:

Replacement for size or color change
The Customer has the right to withdraw without any penalty within 14 days of receiving the goods. It is sufficient for the Customer to send the communication with the request for "Return with refund through purchase voucher" to the address info@selleriapigna.co . Selleria Pigna will collect the item free of charge and once the condition of the product has been verified, will send the purchase voucher directly by email. The new shipment and any differences to be paid will be borne by the Customer.

Return with refund (right of withdrawal)

In accordance with the provisions of articles 52 et seq. of Legislative Decree 205/2006 (consumer code), Selleria Pigna recognizes the Consumer Customer's right to withdraw from the contract, without having to provide any reason, by returning the purchased products with consequent refund of the price.
The return of the products by the Customer must take place within 14 working days from the exercise of the right of withdrawal.

The Customer has the right to withdraw without any penalty within 14 days of receiving the goods.
The customer is responsible for returning the items using a courier of his choice.
It is sufficient for the Customer to send the communication with the request for "Return with refund" to the address info@selleriapigna.com
The return of the products by the Customer must take place within 14 working days from the exercise of the right of withdrawal.
If the Customer withdraws from the contract, all payments made to us will be refunded (with the exception of the supplementary costs resulting from the Customer's request for a delivery other than the least expensive type of standard delivery offered by us). The refund may be withheld beyond 14 days only until the Customer has demonstrated that he has sent back the goods or until they have been received by us, depending on which situation occurs first.
Such refunds will be made using the same payment methods as the Customer, unless otherwise agreed by the Customer; in any case, the Customer will not have to bear any costs as a consequence of such refund.

Attention:
  • In the event that the return is damaged, Selleria Pigna will return the purchased item to the sender, charging the latter the shipping costs.
  • The Customer is responsible for the decrease in value of the goods resulting from the handling of the goods other than that necessary to establish the nature, characteristics and functioning of the goods.
  • Once the official shipping notification has been sent ("your order has been shipped"), the customer will no longer have the right to cancel the order.


9. WAIVER AND TOLERANCE - EXCLUSION OF LIABILITY FOR FORTUITOUS EVENTS AND FORCE MAJEURE

In the event of non-compliance by the Customer with these General Conditions of Sale, Selleria Pigna's failure to exercise the right to take action against the Customer does not constitute a waiver of the right to take action for the violation of commitments undertaken.
Selleria Pigna cannot be held responsible for the failure to comply with these General Conditions of Sale in the event that this is due to fortuitous events and/or force majeure, including, by way of example and not limited to, those connected to natural disasters, terrorist acts, war, network malfunctions and/or blackouts.


10. APPLICABLE LAW AND JURISDICTION

These General Conditions of Sale and therefore the contract concluded between the Customer and Selleria Pigna is subject to the Law of the Italian Republic and is subject to the Jurisdiction of the Italian Judge, subject to the limitations of the law in the event that the Customer has the status of consumer.
For any civil dispute, whether the buyer is a private individual, i.e. a natural person acting for purposes other than any business or professional activity carried out, or whether the buyer is a professional, i.e. a natural or legal person acting in the exercise of his business or professional activity, or his intermediary, the mandatory territorial jurisdiction is that of the judge of the place of residence or domicile of the Customer, if located in the territory of the state.
The possible invalidity of individual clauses of the General Conditions of Sale shall not in any case imply the invalidity of the entire sales contract or of the General Conditions of Sale.


11. ONLINE DISPUTE RESOLUTION

The Consumer resident in Europe is informed that the European Commission has established an online platform that provides an alternative dispute resolution tool. This tool can be used by the European Consumer to resolve in a non-judicial manner any dispute relating to contracts for the sale of goods and services stipulated online and/or deriving from the same. Consequently, if you are a Consumer established in Europe, you can use this platform to resolve any dispute arising from the online contract stipulated on this site.


12. CONTACTS AND COMMUNICATIONS

Except as otherwise provided for by law regarding judicial notifications, for the purposes of these General Conditions of Sale and the sales contract, the Customer declares that he wishes to receive all communications at the addresses indicated at the time of registration on the Site, including email addresses.
